A Tennessee man has turned himself in to authorities nearly eight months after police say he caused a head-on collision that killed a husband and father while seriously injuring the man’s wife and daughter as the family was driving home to decorate for Christmas.
According to the Metropolitan Nashville Police Department (MNPD), James Brewington Jr., 61, surrendered to police on July 23 in connection with the fatal crash that occurred in November 2025.
Brewington has been charged with vehicular homicide by reckless conduct, reckless endangerment, and aggravated assault.
Police Say Driver Crossed Into Oncoming Traffic
According to investigators, Brewington was driving a Nissan Titan pickup truck southbound on a suburban roadway in Nashville when the crash occurred.
Police said another vehicle ahead of Brewington was slowing down to make a right turn.
Instead of waiting, Brewington allegedly attempted to drive around the turning vehicle. During the maneuver, police said he swerved into the northbound lane, where his pickup collided head-on with a Jeep Renegade driven by 41-year-old Dustin McLeod.
The impact caused devastating injuries to everyone inside the Jeep.
Father Dies Following Crash
Emergency responders rushed Dustin McLeod to a hospital by helicopter after the collision.
Despite doctors’ efforts to save him, he later died from his injuries.
His wife, Ashley McLeod, and their daughter both survived but suffered serious injuries in the crash.
Family Was Returning Home to Decorate for Christmas
Following Brewington’s arrest, Ashley McLeod spoke with local CBS affiliate WTVF about the tragedy.
She said the family had been driving back to their home in Smithville, Tennessee, so they could spend time hanging Christmas lights together.
Instead of preparing for the holidays, the family became victims of a crash that claimed Dustin McLeod’s life.
Wife Describes the Moment of Impact
Ashley McLeod said she remembers seeing only a “flash of red” before Brewington’s pickup truck allegedly crossed into their lane.
She described watching the violent collision unfold in front of her.
“I watched my daughter’s body go around her seatbelt. I watched my husband fly forward. And I got hit with the airbag. It knocked the wind out of me for several minutes,” Ashley told WTVF.
Mother and Daughter Suffered Serious Injuries
Ashley said the crash left her with a shattered leg that required multiple surgeries.
Her daughter also suffered significant injuries and had to wear a neck brace for several months during her recovery.
Ashley continues to recover from the physical injuries she sustained in the collision.
Vehicle Caught Fire After Crash
Ashley also recalled the frightening moments immediately after the impact.
She said the Jeep caught fire while she realized her husband was no longer responding.
“The car caught on fire and my husband wasn’t responding to me. My daughter was screaming in the back seat,” she told WTVF.
Emergency responders rescued Ashley and her daughter, but Dustin McLeod could not be saved.
Criminal Charges Filed
After months of investigation, Brewington surrendered to police and was formally charged with:
- Vehicular homicide by reckless conduct
- Reckless endangerment
- Aggravated assault
Investigators allege that his attempt to pass another vehicle by entering the opposite lane caused the fatal head-on collision.
Suspect Held on Bond
Brewington is being held at Nashville’s Downtown Detention Center on a $135,000 bond.
Authorities said a future court date had not yet been scheduled at the time of his arrest.
The case remains under investigation as prosecutors move forward with charges stemming from the crash that claimed Dustin McLeod’s life and left his wife and daughter facing a long recovery after what was supposed to be a family trip home to celebrate the Christmas season.
